“ W O R K    R U L E S ”

PREAMBLE:

 

    The Union of Pari-Mutuel Employees Guild, SEIU, AFL-CIO Local 280 has, under the applicable Collective Bargaining Agreements currently in effect, an obligation to provide qualified clerks to each race track and to each satellite facility for each race meeting conducted in the State of California.

 

     Based upon this obligation, the following work rules shall apply for all members of Local 280.  In most cases the following points merely interpret and clarify the intent of our existing Constitution and By-Laws and our Collective Bargaining Agreements.  In others, they provide guidelines for special situations which, though not specifically covered, require consistent and judicious control.

 

     Any effort to apply the following principles in a narrow or self-serving fashion will create undue and unfair hardship on fellow members.

 

     It should be noted that the following policies are intended for interpretation by mature and reasonable members.

 

APPLICATIONS:

 

1.     Members must indicate to the union whether they are available as Regular Employees or Weekend/Holiday Employees.  From this information the Union shall create and maintain Two (2) types of  Work lists; one type for members who wish to work each and every day or night at a given race track/satellite facility, and another type for those who wish to work Week-ends/Holidays only. (Article V, Section 10 of the By-Laws)

 

EMPLOYMENT QUALIFICATIONS:

 

2.         Any member more than Thirty-Two (32) days delinquent in repayment of obligations to the Mutuel Welfare Fund shall be removed from any and all existing work lists until the deficit is resolved.

 

 3.        Any union member schooled at a given race track/satellite facility shall not be presumed qualified and eligible for the new classification until a subsequent race track/satellite facility begins.

 

WORK LISTS

 

4.           Work lists are prepared for each race track/satellite facility by the Union Office based upon

timely, notification to the union. Members shall be granted work assignments, including premium requests, in accordance with either order of preference as supported by the seniority status. (Article V, Section 1 of  the By-Laws)

 

 

 

5.         Work lists are prepared and updated by the appropriate business representative in three categories ,as       follows:

A.        A Regular Worklist - A list of members who have applied for and may reasonably expect to work each and every day.

 

B.         A Replacement Worklist - A list of members who may expect to work only in the event that the Regular Worklist is either temporarily enlarged, or upon the occasion     that a member on the Regular Worklist is absent and must be temporarily replaced.

 

            C.     A Week-end/Holiday Worklist - A list of those members who wish to work Week-ends/  Holidays only

D.         In the event of a special shift  (in lieu of an Early Bird Shift), a special list will be created

in Seniority  Order for that day only, on the first day of the work week, on a voluntary basis.  (Article V, Section 10 of  the By-Laws).

 

E.      Week-end/Holiday Retirees-members who participate in the W.H.R. program may use their W.H.R. seniority number to work weekends and holidays. W.H.R. day shift is Saturday, Sunday, and Holidays. W.H.R. night shift is Friday, Saturday and Holidays.

 

6.         Members whose names appear on more than one work list for conflicting race tracks/satellite facilities are required to notify the Union or the Business Representative, no less than Seventy-two (72) hours prior to the opening of a given race track/satellite facility of the race track/satellite facility, at which they intend to work. Failure to so notify the Union shall result in the forfeiture of One (1) working day.

 

7.         At race track/satellite facilities receiving more than One (1) signal, each signal will be considered a separate meeting with it’s own separate work list under the following Work Rules: # 13 (A thru D) and # 14.

 

REPORTING FOR WORK:

 

8.         Members who are on a work list that do not appear as scheduled for work without        notifying the  appropriate Mutuel office of their impending absence shall be made to forfeit employment the next day of work.

 

9.    Members on a Replacement work list who are employed on any week-day will take hiring precedence for succeeding Week-end/Holiday employment over members on the Week-end/Holiday work list.  (Article V, Section 10 of the By-Laws)

 

10.       No members will be considered to be on the Regular Work list merely be working opening day at any given race track/satellite facility.

 

 

 

 

 

 

 

 

 

LEAVING/RETURNING SEPARATE RACE TRACKS/SATELLITE FACILITIES:

 

11.       Each host track and each satellite facility receiving the host signal shall be considered a separate meeting with it’s own separate work list.

 

12.       Any member beginning a race track/satellite facility, or entering a race track/satellite facility in progress will be expected to complete said race track/satellite facility, except under certain carefully controlled circumstances.  The following, therefore, are the conditions for leaving a race track/satellite facility, and the stipulations for later returning to the original race track/satellite facility.

13.       Any members who at a given race track/satellite facility are offered, but refuse an alternate position to that which they have indicated as their first choice, or those with one choice only, will not be considered as either bumped or laid off.

Members leaving a race track/satellite facility under such circumstances may not return to the original race track/satellite facility in the same season under any conditions whatsoever.

 

GENERAL:

 

14.       Members hired either as replacements for other employees who are absent or granted assignments resulting from an enlarged crew, will be made from the Replacement Work list in order of seniority and classification preference.

 

15.       No member shall be permitted to work more than Six (6) days consecutively under the Collective Bargaining Agreements with the race tracks/satellite facilities, except by Board action to cover special emergencies.

 

16.       Members will not be allowed to leave an active or concluding race track/satellite facility and bump into a successive race      track/satellite facility on a Sunday.

 

17.       Members will not be permitted to leave an active or concluding race track/satellite facility and bump into another race track/satellite facility if the remaining time gap at the alternative race track/satellite facility is Six (6) days or less.

 

 18.      No member, under the jurisdiction of Local 280 will be allowed to work more than One (1) shift in a single racing day ahead of a member who has not been assigned and is available for work that day.  Said member will be fined One (1) day’s wage for every double shift worked.

Members who have an assigned shift at night, and who work during a day shift when “all union” are used, are allowed to use their seniority number to work their assigned night shift. Union members always work ahead of permit workers.

 

19.       Members who are Extra Employees Only at a race track/satellite facility where they are obligated

and have fulfilled their obligation at that race track/satellite facility, may, with proper notification to the Business Representative, after all Union Members at another race track/satellite facility are hired, work ahead of non-union (permit) at another race track/satellite facility.

           

20.       Members effected by the closure of a race track/satellite facility for a period of Five (5) racing days or

more, may elect to work another race track/satellite facility, based upon seniority, during this time, but these numbers effected must return      to original race track/satellite facility upon it’s reopening.

 

21.     The preceding Work Rules have been voted in by Membership and cannot be changed or waived except by a majority vote of the Executive Board or Membership with exception of Work Rule # 15.
